General conditions of sale (GCS)

Article 1 - This seasonal rental agreement is reserved for the exclusive use of the accommodation rental referenced as non-professional furnished rental:

Article 2 - Duration of the stay:

The tenant signing this contract for a fixed term shall in no circumstances be entitled to any right to remain on the premises at the end of the stay.

Arrivals are from 4:00 pm unless exceptional circumstances negotiated between the tenant and the owners and confirmed in writing by Mrs. Hiart Lolita or Mr. Hiart Ludovic.

Departures will be no later than 11:00 am unless exceptional circumstances negotiated between the tenant and the owners and confirmed in writing by Mrs. Hiart Lolita or Mr. Hiart Ludovic.

Article 3 - Conclusion of the contract:

The reservation becomes effective once the tenant has paid the total amount of the rental excluding tourist tax, security deposit, and additional charges. On the day of your arrival, this contract must be signed accompanied by the security deposit form and the inventory. A second copy is to be kept by the tenant.

The rental concluded between the parties to this deed may not in any case benefit, even partially, to third parties, natural or legal persons, without the written agreement of the owner.

Any breach of this latter paragraph may result in the immediate termination of the rental at the tenant's expense, with the rental proceeds remaining definitively acquired by the owner.

Article 4 - No right of withdrawal:

For reservations made by mail, telephone, or internet, the tenant does not benefit from the withdrawal period, in accordance with Article L121-21-8 of the Consumer Code relating in particular to accommodation services provided on a specified date or according to a specified periodicity.

Article 5 - Cancellation by the tenant:

Any cancellation must be notified by registered letter to the owner.

5.1. Cancellation before arrival:

- less than 21 days: the deposit remains acquired for the owner and the latter may request the balance.
- between 21 days and 90 days: the deposit remains acquired for the owner and the latter cannot request the balance.
- beyond 90 days: the deposit is refunded to the tenant by the owner and no additional amount can be requested by the owner.

Cancellations within 21 days and between 21 days and 90 days become null and void in the event of hospitalization or death of the person, their spouse, child, or parent (father or mother). It will also be mandatory to provide a certificate within 12 days. After this period and without a certificate, no payment from the owner can be made to the tenant.

5.2. Late arrival:

If the tenant does not show up within 24 hours following the arrival date indicated on the contract, this contract becomes null and void and the owner may dispose of the cottage.

The deposit is also retained by the owner, who will request payment of the balance of the rental.

5.3. Shortened stay:

 

If the stay is shortened by the tenant, the rental price remains acquired by the owner. No refund will be made.

 

Article 6 - Cancellation by the owner:

 

The owner reimburses the tenant the entire amount paid.

 

Article 7 - Arrival:

 

The tenant must arrive on the day and at the time specified in this contract. In the event of late or delayed arrival, the tenant must notify the owner by telephone.

 

Article 8 - Payment of the balance:

 

The balance of the rental and the tourist tax will be paid upon entry into the

premises. The tourist tax will be a maximum of €1.65 per day per person.

 

Article 9 - Inventory:

 

An inventory is drawn up jointly and signed by the tenant and the owner or their representative on arrival and departure from the cottage. This inventory is the only reference in case of dispute concerning the condition of the premises.

The cleanliness of the cottage upon the tenant's arrival must be noted in the inventory. Cleaning of the premises is the responsibility of the tenant during the rental period and before departure. The amount of cleaning fees is based on the calculation mentioned in the nightly rate.

 

Article 10 - Security deposit:

 

Upon arrival, a security deposit of €500 is requested by the host. Payment can be made by cheque or in cash. After a joint inspection of the property at check-out, the deposit will be returned, minus any charges for damage or necessary repairs.

In case of early departure (prior to the time stated in the rental agreement) that prevents the check-out inspection from being carried out, the deposit will be returned by the host within one week.

 

Article 11 - Use of premises:

 

The tenant must ensure the peaceful nature of the rental and use it in accordance with the intended purpose of the premises.

After 10:30 pm, vehicles cannot be parked inside the establishment. Therefore, it will be required to park in front of the owners' house to respect the neighborhood.

 

Article 12 – Equipment:

 

In case of breakage of crockery, please report it so that replacement can be made for the following tenants. Beyond 2 broken items of crockery, they may be charged to you.

 

Article 13 - Valuables:

 

It is recommended not to leave valuables in the accommodations and to use the safes provided.

 

Article 14 - Capacity:

 

This contract is established for a maximum capacity of people, depending on the rented cottage. It cannot be exceeded for reasons of safety and insurance. The owners reserve the right to refuse access to the accommodation if the number of people exceeds the maximum occupancy allowed. Any modification or termination of the contract will be considered at the client's initiative.

 

Article 15 – Pets:

This contract specifies that the tenant cannot stay with any pets whatsoever. In case of non-compliance with this clause, the owners may refuse the stay: no refund will be made.

 

Article 16 - Smoking:

 

Smoking is prohibited inside the cottages. Ashtrays are provided outside, it is imperative to use them properly.

 

Article 17 - Insurance:

The tenant is responsible for all damages occurring as a result of their actions. They must be insured by a vacation-type insurance contract for these various risks.

 

Article 18 - Payment of charges:

 

At the end of the stay, the tenant must pay the owner the charges not included in the price. Their amount is based on the calculation mentioned in this contract and in the descriptive sheet, and a receipt is provided by the owner.

 

Article 19 - Disputes:

 

Any complaint regarding the inventory and the condition of the description during a rental must be sent within 7 days by registered letter with acknowledgment of receipt to the owners. After this period, no claim can be made.

Article 20 – Use of the SPA

 

The gîtes Le Cosy and Le 189 are equipped with a private spa available to guests, subject to strict compliance with the conditions below.

Use of the spa implies full acceptance of these terms.

 

The private SPA at Le Cosy is optional: €30 for 2 people / 1.5 hours. Advance booking required. Full details provided after confirmation.

 

1. Access Conditions

 

  • Access to the spa is limited to 1.5 hours per day.

  • Use of the spa is strictly prohibited in case of bad weather, including heavy rain, strong wind, storms, or snowfall. (Strong wind is defined as from 30 km/h, with gusts reaching approx. 45–50 km/h.)

  • The minimum age to use the spa is 16 years, unless accompanied by a responsible adult.

 

2. Hygiene and Safety

 

  • A shower is mandatory before each use of the spa.

  • Swimsuits must be rinsed with clear water beforehand (detergents, creams, and oils are prohibited).

  • It is strictly forbidden to eat, drink (including alcohol or sweetened beverages), or smoke in or near the spa.

  • The spa must not be used after applying any body product (sunscreen, oils, perfume, etc.).

 

3. Proper Use and Responsibility

 

  • Any improper use or non-compliance with these rules may result in a flat fee of €100 for cleaning or early water change.

  • In case of intentional or accidental damage, actual repair costs will be invoiced to the guest after inspection.

  • As cleanliness, safety, and peacefulness are priorities, the management reserves the right to suspend access to the spa in case of repeated rule violations.
